Howard Citron and Sarina Bonanno Obtained a Motion to Dismiss with Prejudice in Broward County

Howard Citron and Sarina Bonanno successfully obtained a Motion to Dismiss with Prejudice in Broward County on behalf of one of the firm’s hospital clients. The Court found that Plaintiff failed to participate in the pre-suit investigation procedure, failed to consult with an appropriate medical expert witness, and failed to obtain a written, verified expert affidavit corroborating her claims as mandated by Fla. Stat. §766.203(2), prior to filing the action. In addition, Plaintiff failed to timely pre-suit her claims prior to the expiration of the two (2) year statute of limitations as mandated by Fla. Stat. §95.11(5)(c) for medical malpractice actions. As such, the Court granted Defendant’s Motion to Dismiss and forever barred Plaintiff’s claims.
